Agreement to Terms

Welcome to Krishna Gaadi Paadi Fund (KGF). By accessing our website, filing a complaint, or using our legal assistance services, you agree to be bound by these Terms of Service. Please read them carefully. If you disagree with any part of these terms, you may not access our services.

1. About Our Services

1.1 Mission and Scope

KGF is a non-profit organization founded by Justice N. V. Ramana (Retd.) to provide free legal assistance to marginalized and economically disadvantaged individuals in Andhra Pradesh, particularly Kadapa district. We offer:

  • Legal consultation and advice
  • Case evaluation and documentation support
  • Mediation and dispute resolution services
  • Court representation (subject to case merit and resource availability)
  • Coordination with government authorities
  • Legal awareness programs

1.2 Eligibility

Our services are primarily for individuals who:

  • Reside in Andhra Pradesh (priority given to Kadapa district residents)
  • Have genuine legal grievances requiring assistance
  • Lack financial resources to hire private legal counsel
  • Are 18 years or older (minors must be represented by parent/guardian)

2. User Obligations

2.1 Truthful Information

You agree to:

  • Provide accurate, complete, and truthful information when filing complaints
  • Submit genuine documentation and evidence
  • Update us promptly if any information changes
  • Not fabricate or exaggerate facts in your complaint

2.2 Cooperation

During case handling, you must:

  • Respond promptly to requests for information or documentation
  • Attend scheduled appointments and court hearings
  • Follow legal advice provided by our team
  • Inform us immediately of any developments in your case
  • Not engage in parallel legal proceedings without informing us

2.3 Prohibited Conduct

You must NOT:

  • Use our services for frivolous, vexatious, or malicious complaints
  • Harass, threaten, or intimidate our staff or other users
  • Submit multiple complaints for the same issue without authorization
  • Misrepresent your identity or relationship to a case
  • Attempt to access unauthorized areas of our systems
  • Use our platform for any illegal or unethical purposes

3. Case Acceptance and Representation

3.1 No Guarantee of Acceptance

KGF reserves the right to:

  • Review and evaluate all complaints for merit and eligibility
  • Decline cases that fall outside our expertise or mission scope
  • Prioritize cases based on urgency, impact, and available resources
  • Discontinue representation if you violate these terms or provide false information

Filing a complaint does not automatically establish an attorney-client relationship. Representation begins only after formal case assignment and written confirmation.

3.2 Limited Scope Representation

Our representation may be limited to specific aspects of your case (e.g., initial consultation, document preparation, mediation). Full court representation is provided subject to case complexity, merit, and resource availability.

4. Fees and Costs

4.1 Free Services

KGF provides legal assistance free of charge. We do not charge:

  • Consultation fees
  • Service charges for case management
  • Legal representation fees

4.2 Court Costs and Expenses

While our services are free, you may be responsible for:

  • Court filing fees (if applicable)
  • Document certification and notarization charges
  • Travel expenses for case-related visits
  • Expert witness fees or technical reports (if required)

We will inform you in advance of any costs you may incur and seek alternatives wherever possible.

5. Disclaimers and Limitations

5.1 No Outcome Guarantee

Important: Legal outcomes depend on facts, evidence, applicable law, and judicial discretion. KGF makes NO GUARANTEE regarding the outcome of any case. We will provide competent representation, but cannot promise specific results.

5.2 Not a Substitute for Professional Counsel

Information provided on our website or during initial consultations is for general guidance only and does not constitute formal legal advice. For complex matters, we may refer you to specialized legal practitioners.

5.3 Third-Party Actions

We are not responsible for:

  • Actions or inactions of opposing parties, government officials, or courts
  • Delays caused by judicial backlog or administrative processes
  • Changes in law or legal precedents affecting your case
  • Technical issues with third-party government portals or systems

6. Confidentiality and Communication

6.1 Attorney-Client Privilege

Communications between you and our legal team are protected by attorney-client privilege, subject to exceptions under Indian law (e.g., ongoing crime, fraud, imminent harm to others).

8. Intellectual Property

8.1 Website Content

All content on our website (text, graphics, logos, guides, videos) is owned by KGF or licensed to us. You may:

  • Share our educational resources with proper attribution

You may NOT:

  • Reproduce, distribute, or commercially exploit our content without permission
  • Remove copyright or attribution notices
  • Modify or create derivative works without authorization

8.2 User-Submitted Content

You retain ownership of documents and information you submit. By uploading content to our platform, you grant KGF a non-exclusive license to use, store, and process that content solely for providing legal services to you.

9. Limitation of Liability

To the fullest extent permitted by law, KGF and its staff, volunteers, and associates shall NOT be liable for any indirect, incidental, consequential, or punitive damages arising from:

  • Use or inability to use our services
  • Adverse case outcomes or legal decisions
  • Errors or omissions in advice or representation
  • Delays or interruptions in service
  • Loss of documents or data (despite our security measures)
  • Actions of third parties (opposing counsel, government officials, courts)

Our liability, if any, shall be limited to direct damages not exceeding ₹10,000 or the actual harm proven, whichever is lower.

10. Termination

10.1 By You

You may terminate representation at any time by providing written notice to us. We will provide you with copies of your case files and documents.

10.2 By KGF

We may terminate representation if:

  • You violate these Terms of Service
  • You provide false or misleading information
  • You fail to cooperate or communicate despite repeated attempts
  • A conflict of interest arises
  • You engage in conduct that jeopardizes the case or our reputation
  • The case lacks legal merit after initial assessment

We will provide reasonable notice and assist with transition to alternative representation where possible.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kadapa, Andhra Pradesh.

12. Changes to Terms

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of law, that provision shall be modified to the minimum extent necessary, and all other provisions shall remain in full force and effect.

Truth, Documentation, and Legal Compliance

15.1 Truth as Foundation

All case information published on our platform is based on complainant testimony, supporting evidence, and documentation submitted to Krishna Gaadi Paadi Fund. All statements are "alleged" pending investigation or judicial determination. We operate under the principle of "truth defense" - that truthful statements made in good faith on matters of public interest are protected speech.

15.2 Documentation Requirements

To maintain the integrity of our platform and ensure legal protection, all published cases must meet comprehensive documentation standards defined in our Case Documentation Checklist. Significant allegations must be supported by:

  • Written complaints with complainant's sworn statement (notarized affidavit required)
  • Minimum 3 supporting documents (property records, agreements, correspondence, etc.)
  • Identity verification (Aadhaar/Voter ID/Passport)
  • Witness statements where applicable (notarized preferred)
  • Photographs, videos, or audio recordings as evidence (with timestamps)
  • Government records, court documents, or police reports where available
  • SHA-256 checksums for all uploaded documents (ensures integrity)

15.3 Right to Reply

Any person who believes they are referenced or affected by a published case has the right to submit their response. Responses are published verbatim (unless obscene or threatening) alongside the original allegations, demonstrating our commitment to fairness and balance.

How to Submit: Visit the published case page and click "Submit Your Response" to access our public reply form. Alternatively, contact us at legal@kgf.org with your case number and statement.

You have the right to:

  • Provide your version of events in your own words
  • Submit counter-evidence or documentation supporting your position
  • Have your response published without editorial changes (verbatim)
  • Request correction of factual errors with supporting proof

15.4 Audit Trail and Preservation

All case documents, evidence, and submissions are preserved with cryptographic checksums (SHA-256) and immutable audit logs. This ensures that in any legal proceedings, we can demonstrate the exact information provided by complainants and the timeline of events.

15.5 No Malice or Defamatory Intent

KGF operates solely to serve the public interest by helping victims access justice. We do not publish allegations with malicious intent or reckless disregard for truth. All published information reflects complainant testimony and supporting evidence as provided. Determination of guilt or innocence rests with courts and law enforcement, not this platform.

15.6 User-Generated Content Disclaimer

CRITICAL LEGAL NOTICE: KGF is a platform that publishes allegations based on complainant affidavits and supporting evidence. We are NOT the originator of these allegations.

All published cases represent complainant testimony supported by documented evidence. KGF does not guarantee the truth of all allegations but maintains rigorous verification standards to ensure credibility. We present allegations as stated by complainants using appropriate "alleged" language pending investigation or judicial determination.

Our Role: We verify documentation, ensure evidence requirements are met, and provide a transparent platform for justice-seeking. We do NOT:

  • Independently investigate allegations beyond verifying documentation
  • Make conclusive determinations of guilt or innocence
  • Add editorial commentary or accusations beyond complainant statements
  • Publish unverified rumors or hearsay

Legal Responsibility: Complainants are legally responsible for the accuracy of their sworn statements. Published cases are based on complainant testimony supported by documentary evidence.
